The Process for Buying a Handgun From a Texas Gun Store
Form 4473, the NICS check, wait times, and what to expect from the moment you walk in to walking out with your handgun.
Buying your first handgun from a Texas gun store isn’t complicated. Bring your ID, know your budget, and know what you want. Here’s the walkthrough.
Step 1: Pick the firearm
Handle it. Check trigger reach and grip. A pistol that fits your hand shoots better than a pistol that doesn’t, no matter what the internet says about caliber wars. A good shop will let you dry-fire and try holsters.
Step 2: ATF Form 4473
You’ll fill out the 4473 at the counter. Personal info, address, ID number, and yes-no questions about prohibiting factors. Answer truthfully. Every question. Lying is a federal felony.
Step 3: NICS background check
The dealer submits your info to the FBI’s National Instant Criminal Background Check System. You’ll get one of three responses.
- Proceed: You’re clear. Walk out with the firearm today.
- Delay: The system needs more time. Federal law allows the dealer to release after 3 business days if no denial comes back, but many FFLs choose to wait for a definitive answer.
- Deny: Something on your record blocked the transaction. You can appeal through the FBI, but the dealer cannot release the firearm.
Step 4: Pay and walk
Cleared? Pay, take your paperwork, and go. There’s no state-mandated waiting period in Texas. If the NICS check comes back “proceed,” you leave the shop with the gun the same day.
What to bring
- Valid Texas driver’s license or ID with your current address.
- Payment.
- Optional: LTC card, which speeds up the background check dramatically for LTC holders.
Stay safe. Semper Fi.
Gunny
Straight talk: This is education, not legal advice. Gun law changes. Consult a Texas attorney for your specific situation, and always confirm current rules with the Texas Department of Public Safety and the ATF.
